The Islamabad High Court (IHC) has suspended the implementation of a decision directing a private airline, Airblue, to pay around Rs5.04 billion in compensation to the families of victims of the 2010 private airline plane crash in the federal capital.
IHC’s Justice Arbab Muhammad Tahir heard the appeal filed by the airline against the order of a district and sessions court in Islamabad.
The IHC judge after hearing the preliminary arguments issued a stay order on the airline’s petition and served notices to the parties, directing them to submit their replies by April 23.
Airblue’s counsel, Hasan Mandviwalla, argued that the lower courts had imposed liability beyond the statutory limits without any finding of willful misconduct.
Mandviwalla further noted that the Carriage by Air Act 1934, which applied at the time of the crash, imposes an even lower liability threshold.
